    Tax, Spending Issues Frustrate Democrats (http://www.washingtonpost.com/wp-dyn/content/article/2007/12/07/AR2007120700423.html) By CHARLES BABINGTON | Associated Press, December 7, 2007

    WASHINGTON -- Cracks are emerging in congressional Democrats' solidarity, as frustrated lawmakers concede their majority status is not enough to overcome Republican resistance on taxes, spending, Iraq and a host of other issues.

    The fissures, which became obvious this week, are undermining Democrats' hopes for several key achievements this year. They also point to a bruising 2008 election in which Democrats will say Republicans blocked prudent tax and spending plans to score political points on immigration and other hot-button issues.

    Republicans say they simply want to prevent higher taxes of any kind, even if the targets are not-so-sympathetic groups such as oil companies and hedge fund managers.

    After 11 months of insisting that all major programs be paid for with tax increases or spending cuts elsewhere, Senate Democratic leaders acknowledged Thursday they cannot persuade enough Republicans to join them. Majority Leader Harry Reid, D-Nev., reluctantly allowed a vote on a long-debated middle-class tax cut that would add billions of dollars to the deficit because it is not offset elsewhere.

    The measure, which the Senate approved 88-5, would prevent the alternative minimum tax from hitting about 25 million more taxpayers, at a cost of about $50 billion to the U.S. treasury next year. Reid's decision puts the Senate at odds with the House with two weeks left before the holiday recess.

    House Democratic leaders still insist on a pay-as-you-go policy, or "pay-go," which they made a centerpiece of their governing principles in January.

    Reid told reporters Thursday that Senate Republicans have used their filibuster powers to block Democratic efforts to change Iraq policy, move a farm bill and pay for the proposed one-year "fix" to the alternative minimum tax. He especially complained about Republican demands to offer farm bill amendments dealing with state drivers licenses for illegal immigrants.

    "We've tried everything we can to address these issues," Reid said, citing 57 GOP filibuster threats this year.

    "We have lived by pay-go," Reid said regarding the tax bill. "But what we want everyone to know is that we have tried every alternative possible."

    He acknowledged handing a political dilemma to House Speaker Nancy Pelosi, D-Calif. The House earlier passed an AMT bill that would raise $80 billion in new taxes, largely on investors and hedge fund managers.

    "I admire the speaker" for adhering to the pay-as-you-go principle, Reid said. He added, however, she "has a little more flexibility from a procedural perspective than I do."

    Reid's decision will force a pivotal decision by House Democrats: Should they infuriate millions of voters by leaving the AMT unchanged (and hope Republicans get blamed), or abandon the pay-go promise and possibly rely heavily on Republican votes to pass a bill that splits Democrats.

    "If we waive pay-go on this, I think it opens the door" to further actions that would raise the deficit and "border on criminal irresponsibility," said Rep. John Tanner, D-Tenn.

    Meanwhile Thursday, congressional Democrats said they face an uphill battle in trying to overcome Senate GOP objections to a House-passed energy bill. Republicans particularly oppose the proposed rollback of $13.5 billion in tax breaks for major oil companies.

    "You can't tax your way to energy independence," House Minority Leader John Boehner, R-Ohio, told reporters.

    If the Senate cannot overcome the GOP-led resistance, Democratic senators said they may have to jettison provisions important to many House Democrats: the tax provisions and requirements for greater use of renewable energy such as wind, solar and biofuels.

    House Ways and Means Committee Chairman Charles Rangel, D-N.Y., said such a move would be difficult for the House to swallow. "The tax part is just as important as any other part" of the energy bill, he said.

    As for the Iraq war, congressional Democrats on Thursday sent their strongest signal yet that they are resigned to providing additional funds without forcing President Bush to alter his policies. The plan is virtually certain to divide House Democrats. Like the AMT legislation, it may require significant Republican support to pass.

    Democrats, who sometimes seem incredulous at their inability to budge the GOP on tax, spending and war issues, say Republicans will pay dearly at the polls. "There is a sense they are digging their own grave," Sen. Charles Schumer, D-N.Y., said.

    Some Republicans agree there is a risk in repeatedly blocking Democratic-crafted bills, especially if the chief beneficiaries appear to be big oil companies or wealthy investors.

    "The strategy is to lay low and then blame them for not getting anything done," Republican Rep. Ray LaHood of Illinois said in an interview. "The truth is, we all lose."

    "We trash each other and end up making the institution look bad," LaHood said. "That's why Congress' approval ratings are so low."

    Republicans may trail in the polls on virtually every issue, but conservative influence is surging in both chambers of Congress as the GOP tries to find its soul again.

    It�s a risky strategy to tack to the right while Democrats have momentum in most polls, but Republicans clearly believe that they need to recapture their base before they recapture the majority.

    When Republicans ran Congress, hardened fiscal conservatives often had a lone voice-in-the-wilderness feel about them.

    Whether it was Sen. Tom Coburn (R-Okla.) filibustering on earmarks or Rep. Jeb Hensarling (R-Texas) making a late-night speech about runaway government spending, the conservative caucus had a sympathetic ear from GOP leaders yet rarely prevailed on strategy or party message.

    But now that they�ve been thrust into the minority, the conservative agitators have a front-row seat with Republican leaders, and the number of lawmakers who describe themselves as conservatives continues to grow while moderates appear to be a dying breed among Republicans on Capitol Hill.

    In the House, the conservative Republican Study Committee has led the caucus in promising to sustain vetoes of children�s health care legislation and spending bills.

    In the Senate, the conservative Republican Steering Committee, led by Sen. Jim DeMint (R-S.C.), is now being invited to weekly Republican leadership meetings on appropriations, a departure from tradition.

    The top members of the Senate steering committee also had an exclusive meeting recently with President Bush, who himself is trying to launch a sort of renaissance of fiscal conservatism by vetoing popular spending bills.

    The Republican Study Committee now has 104 members, up 50 percent in the past five years.

    And 12 of the 15 Republican freshman lawmakers joined the group this year, a clear sign that the small rookie class of Republicans still believes in a conservative future, even while its party struggles nationally.

    In contrast, the moderate Republican Main Street Partnership has seen its membership decline 20 percent, from 59 lawmakers in the last Congress to 47 this year.

    And seven of those moderates are retiring, further diminishing the power of the middle.

    �We don�t need to be shy about what we believe in,� DeMint said in an interview. �We�re starting to act as Republicans around core principles, whether it�s SCHIP or earmarks.�

    Democrats are happy to see the Republicans taking a sharp right turn, believing it makes winning independents in 2008 that much easier.

    �Republicans can�t try to make fiscal responsibility their mantle when they are responsible for turning record surpluses into record deficits,� said Sarah Feinberg, spokeswoman for the House Democratic Caucus.

    �They can�t whine about earmarks when earmarks exploded under their leadership and Democrats have cut them in half and brought accountability to the earmark process.�

    The renewed influence by conservatives in the House and Senate Republican caucuses appears to be disconnected from recent poll results.

    According to a Washington Post/ABC News poll released Nov. 4, Americans favor Democrats in handling the economy, 50 percent to 35 percent, and on taxes, 46 percent to 40 percent, showing that Democrats have gained an edge on fiscal issues usually dominated by Republicans.

    Independents are also disgruntled. In a Fox News/Opinion Dynamics poll last month, 63 percent of independents disapproved of the president�s performance.

    Some Republican congressional aides privately admit that the energized push for conservative issues amounts to a �minority strategy� in which the party must reclaim its identity after being thrown out of power on Capitol Hill before making a serious run at regaining the majority.

    �The far right is not going to bring the Republican Party back to power,� said Charlie Bass, president of the Main Street Republican Partnership and a former GOP House member from New Hampshire.

    �The districts that were lost were moderate districts. The far right is big on bluster but short on results.�

    Congressional Republican leaders, meanwhile, have been coordinating their efforts with some of the leading minds of the party, including pollsters Frank Luntz and David Winston, and Pat Toomey, president of the conservative Club for Growth.

    Republican aides say they�ve also had strategy meetings with former House Speaker Newt Gingrich (R-Ga.).

    At its core, this is an effort to re-energize a party demoralized after last year�s elections.

    �We need to do a better job of communicating our core beliefs,� said Danny Diaz, a spokesman for the Republican National Committee. �We had strayed from the core beliefs that got us the majority.�

    Still, the strategy of flexing conservative credentials at the expense of the middle carries great risk.

    �The image of the party message being dictated by a small group of doctrinaire senators is not something that people at the top of the ticket are going to want,� said Ross K. Baker, a political science professor and congressional expert at Rutgers University.

    �This [strategy] springs up when a party is in the minority and prospects are bleak, so it�s unsurprising they�re having a reawakening.�

    Indeed, Republicans are finding it easier to create a unified front on spending, immigration and national security as the minority party because they don�t have to legislate, don�t control the congressional schedule and are outnumbered at virtually every turn.

    �There were times in the majority when conservatives disagreed with leadership, but there have been very few of those times this year,� said Hensarling, chairman of the Republican Study Committee.

    �There�s nothing like getting hit over the head with a two-by-four to get someone�s attention. The American people thought Republicans weren�t acting like Republicans.�

    To be sure, conservatives have always had significant influence within the Republican leadership in both chambers.

    But when it came time to cut deals on spending or to craft bipartisan legislation, they often felt like they were cut out of the process.

    Many Republicans still regret the arm twisting on their side of the aisle that led them to vote in favor of the Medicare prescription drug benefit in 2003, creating one of the biggest entitlement programs of all time.

    Now Republicans are getting their sea legs as a minority party on Capitol Hill, and their rabble-rousers serve a useful purpose in opposing the Democratic majority, especially on spending bills.

    Democrats have little chance to override any of the president�s threatened vetoes of appropriations measures, thanks in large part to Republican unity on the issue.

    �These fights on spending are important for us to re-establish our credentials,� said House Minority Whip Roy Blunt (R-Mo.). �The Democrats have made it easy for us to engage in that fight.�

    Democrats have indeed been frustrated in both chambers by Republican procedural maneuvers, but they believe voters will see this as obstructionism.

    �It became evident months ago that the only play left in their playbook was to attack Democrats on taxing and spending,� said Jim Manley, a spokesman for Senate Majority Leader Harry Reid (D-Nev.).

    �They needed to shore up what�s left of their base. President Bush and Republicans have engaged in a hypocritical series of attacks on spending issues. The president only recently rediscovered the veto.�

    Hello Attorney,

    I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .

    Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

    I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.

    I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
    This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.

    So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!

    They are asking for:
    1.) Arrest Report.
    2.)Copies of Cout documnet showing final disposition.
    3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.

    Please advise! is this something I should be feareful of?

    Thanks to Googler,

    i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.

    I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

But in a seeming effort to show the Democrats are close to ready to go on immigration reform, Senators Reid, Schumer and Menendez began circulating a detailed outline of a comprehensive immigration reform bill that appears to exclude Senator Graham. There are many positive things in the plan, a few worrisome ones and several new concepts. Incidentally, the new two stage legalization process looks very familiar.     If it was filed in the EB2 category, it is likely that they picked the case for a random audit. EB2 labors do get audited during PERM processing to ensure that the case does meet eligibility requirements for EB2. There is no clear pattern to this auditing though, some cases get audited and some do not.

    I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.

    TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.

    So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

    My I-485 case has been transferred from Texas center to Nebraska and notice says it's for faster processing. My priority date is Nov 2003, EB3 category, indian national. I didn't expect they would be looking at my case now. Why would they transfer it? has anyone received any such notice?
