My friend John Lamb in Nashville has had this idea for a while. It sounds a little nuts at first, but as John notes - Giving American citizens the power of granting legal status to their foreign-born friends is an idea I've had for a while but not trumpeted very much. My PD is still another 10 months away but my AP which was approved 2 months back is getting a Soft LUD everyday since the last 4 days. Does it signify anything?

I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .

I am waiting on my AP for myself and wife. I am not sure for how long the AP is approved for. I saw that it is sent and I should be getting in a couple of days probably.
I also think that something should be done in order to get 3 year EAD/AP since the approval process is taking longer.

We also need to raise our voice for the Out of Status stuff.
Most of the consultants have one or more pay stub missing etc. There needs to be a amendment that more than 6 months so called out of status can also adjust their status by paying some fine or something because
1. Most of the employee are ignorant about this
2. and most employers take advantage of the situation and they are the ones who should be accountable and not the employees.

A new report from the Economic Policy Institute makes the case that immigrants at all wage levels actually lift wages for US workers:A key result from this work is that the estimated effect of immigration from 1994 to 2007 was to raise the wages of U.S.-born workers, relative to foreign-born workers, by 0.4% (or $3.68 per week), and to lower the wages of foreign-born workers, relative to U.S.-born workers, by 4.6% (or $33.11 per week). I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

I heard very good things about Martina Keller of Chicago. I spoke to her once regarding an immigration question and she answered with patience. When I asked about the charge - she said "thats fine.. its just one question". I was impressed.

I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.

I recently got a denial on my audited labor case after 2 years of wait. I had already applied my H1-B 8th year extn on the basis of my pending labor in premium mode. My luck was such that my labor was picked up and denied a day after the H1-B extn was filed.
Questions?
Since the basis of the H1-B extension was pending labor, I think USCIS will reject the extension unless I get lucky.
If I appeal against the denial, is it possible to go back to USCIS to give the H1-B extension on that basis?
DOL site says "standard appeals" is Aug 2007. Does this mean cases of 2007 or appeal filed in 2007 for an earlier denial?
Reason for denial of labor:
Company name was not filed in job advertisement
Job location not specified in the ETA form.
These seem too trivial but nevertheless they sent this in the denial.
My company is looking into the paper work to determine that the above information was mentioned in the application?
Your help/input is highly appreciated in this

I was keep observing the PERM approval rate trend for the past one year. Approval rate is very slow. But it is suddently jumped since last month. Looks like it is a good time to start filing another labor. I am in the same boat. Trying for a new employer for EB2.

Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

Hello friends
I am thinking of taking these semester off because of my health issue
I had decided to attend classes and booked my ticket in April to my country. I am an international student
So I was thinking how many months I can stay in USA after I take a semester break
Also if I take these spring break off and than the summer break is off by default so will it be a problem if I am not in status for 7 months?
