Hi,
Need some help here for my friend.
He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.
So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

I'd suggest contacting Adobe. Surely if you have a product that supports the file-format, and an upgrade of the firmware changes that, it's part of Adobe's support package to allow an upgrade of the Raw File support.

Dear Sir/Madam,
I am planning to move back to India after I get the green card, possibly in the next 2-3 years. I really want the green card for my son (15 years old) who is very keen to come back to the US. If I take him to India to do his undergrad degree in India, will he be able to maintain his green card even if I am not present in US. I can give my brother's address (who lives in Chicago and is a green card holder) as my son's home in US. Will Rentry permit every 2 years for my son work? Or should I wait untill citizenship which seems to be too far considering my PD is nov 2007 EB2. Please advise.

Hi Guys,
My wife is going to go to school this August for her masters. I am on H1 she is here on H4 and My I 140 is cleared. Now my question is
1> Is it possible for her to convert to F1 (she is still not part of the GC process we haven't filed I 485)?
2> What is the process to get this conversion of status done?
3> How long does it take? (we live in California and she will be going to school in CA as well.)
4> I understand that for her to get OPT she should be on F1 but does it matter for how long she has to be on F1?
5> Just change of status is enough of would she need to get F1 Stamped?

Will there be any updates on 485 LUDs when USCIS works on I-140?
I have submitted approved EB3 I140 and 485 on Aug 2nd 2007. I submitted EB2 I140 for approval on Dec 11 2007. There haven't been many LUDs on any of these files except when applied for AP and EAD. Now on Apr 7th 2009 I see new LUDs on EB2 I140 and 485(for both wife and me). There is nothing after that. I am not able to make out anything of it. Any comments, suggestions or opinions are appreciated. Thx

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.
If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

When you travel on AP carry both the copies. On the PoE the IO will keep one and give the second to you after it is stamped. You use the returned/stamped Copy for your future travel
When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?
