    Hi:
My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?
    Thanks so much
    Debbie

Biometrics are not required for AP. You can paper file or efile - it is the same in the case of AP.

My wife paper-filed her EAD and didn't have to do Biometrics.
Will she have to do her Biometrics when she paper-files or e-files her AP?

    Anybody has any experience ?

I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.

My husband's labor was filed in the end of June, no response yet. It was much faster for me in 2006. I would also like to know if anyone got a response.
    Thanks!

    Hi,

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!

If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

From twitter : whitehouse: 3:00 EST Live video chat on DREAM Act with Cecilia Muoz via Facebook

White House Live on Facebook (http://apps.facebook.com/whitehouselive/)

Just missed it. Could only get to hear the last statement. "The Congress already has 50 votes to pass the DREAM ACT. They need at least 60 votes........."

Anyone knows from where to get to see this once again?

    Hello?
I entered U.S with B1/B2 visa and got changed into F1 status. While F1 status got approved
I departed U.S due to family matter.
Now I'd like to make it sure that my B1/B2 visa is still valid, because I plan to visit to my friend who lives in U.S.
How to check my B1/B2 visa could be remained still valid?
Or does somebody know anybody who had been in same situation?
    Thanks in advance.

    Best regards Zulagh.

Many of our clients have been crying tears of joy because of the September Visa Bulletin. The best news is the advance in the family-based 2A category. Just one year ago, the wait exceeded five years. Now, the wait is down to just 8 months! This is very important to persons who were granted green cards under the EB-3 category before the retrogression, and who have been waiting for years for their spouses/children to follow to join them. Last week, I spoke to a nurse who got her green card in 2007 based on her 2006 EB-3 priority date. She...

The Washington Post reports on data released from the Border Patrol. Among the findings: - The number of Border Patrol agents has more than doubled from 9,000 in 2001 to 20,000 this year - 626 miles of the border with Mexico are now covered by fencing and vehicle barriers which is about half of the planned coverage on the 2000 mile border. - Border arrests are down from nearly 1.75 million in 2000 to 723,000 over the past year While the economy obviously plays a role, the dramatic uptick in enforcement sure is playing a role and Senator Schumer's contention...

Last Tuesday, Chuck Kuck, immediate Past-Prez of AILA, and I covered the landscape of current developments in U.S. immigration law and policy on "The Immigration Hour," Chuck's weekly program on America's Web Radio. If you've grown weary of the health-care debate and are hankering for the next large public controversy, give a listen. We covered the origin and current exploits of the USCIS Fraud Detection and National Security (FDNS) unit, the latest meanderings of their outsourced compatriots who are paying visits to American employers from sea to shining sea, and the prodding of Sen. Grassley to find more and more...

    Hello,

Please let me know if anybody is travelling from BLR(Bangalore) to BOS (Boston) by British Airways on Mar 1 2011.

Because my mother-in-law is visiting US and she is travelling alone. If some travel companion is there it will be helpful as she does't speak english.

    Thanks in advance.

Some of you may know that I've been a co-author of the annually published LexisNexis' J-1 Visa Guidebook for the last dozen years. J-1 visas are used by a variety of folks including students and researchers training in a lot of fields. For many decades, J-1s from developing countries have been required to comply with a requirement to return to their home countries for two years following their J-1 time in the US. The idea is that the J-1 program is a part of the US foreign aid system and the two year requirement is a way to ensure that...

    Hi,
I received RFE on my 485 for I94 copy. My situation is below

I travelled to Tijuana, Mexico from San Diego by road to request
for new I94 at the US Port of Entry at San Ysidro, Tijuana as my old I94
was issued only until PP expiry date but since i already had a valid I94 on H1B notice, The officer didn't issue a new white I94 card even though i requested for one. Also, The officer took my earlier old white I94 card, so i don't have one with me now though i have a copy
of it. Also USCIS is asking for a detailed explanation as to why new I94 was not issued at POE. please advise on how to respond to this RFE

Opponents of comprehensive immigration reform often point to the 1986 legalization bill as a great failure that should not be repeated. What they don't want to talk about are the great number of success stories for people who were able to become legal. One story that is making the news 25 years later is that of Ana Hernandez Luna who gave an extraordinary speech on the floor of the Texas House of Representatives where she told her own story of her life as a young undocumented immigrant in the 1980s. The Texas Observer reported on her remarks: Tuesday, after it...
