Hi,
I recently (a couple of months ago) switched firms. I have a valid H-1B visa stamp from my prev employer (expiring in Aug 2009). My H-1B transfer was approved and I have a valid I-797.
Can I travel to London, for a week's vacation and re-enter with my prev employer's h-1b visa stamp and the new I-797? I've read that this is possible and that folks have done it.
I was wondering if there was any change to the rule or anything I should be aware about.

I know this one guy has done this he worked on h1 for 6 years after that he didnt get extension so he changed his status to f1 as full time student ...now he is on f1 visa...so dont worry.

Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...

My I-485 has been denied based on the fact that I entered the country illegally in 1985.
My last USA entry was in 1998. It was a legal exit and entry. I was given a permit to make a trip to South America. Can the fact that my last entry was legal be enough to reopen the petition? Can I used my last entry as basis for my I-485 adjustment?

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

Hello everyone,
Few weeks ago I had filed my wife's H-4 through my H1B. We have already received the receipt for her H4 filing. The H4 has not been approved or for that matter denied. She got a new job and she needs to start in few days. She intends to use the EAD that she got from our I-485 filing. She had never used her EAD before.
The questions I have is -
Do I have to do anything to notify the USCIS or let it be?
What will be implication on her H4 petition, will that be denied because she used her EAD?
Any suggestions would be greatly appreciated.

Hello gurus..
I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?
All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B
extension plus recapture time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
