Requirements for non immigrant visa:
A foreigner applies for a non-immigrant visa when he/she wants to stay or work in Thailand. This visa has several categories:
* diplomatic visa (D) is for those employed by an embassy,

* an expert visa (EX) are for those performing skilled or expert work,

Jan'09 : My Employer submitted H1B - Vacation Recapture + Extension based on pending I-140
Feb'09 : RFE was issued asking information related to Company
Feb'09 : H1B - 6 Years completed : H1B Visa / I-94 Expired in Passport
Mar'09 : RFE responded with the requested information
Apr 10, 2009 : USCIS Denied H1B Extension petition.
I understand from my employer that I can no longer be on the US payrolls and that I've to leave the country in 180 days.
Is Motion to Reopen (MTR) / Appeal is an option to legally stay in US ? If MTR is submitted, can I continue to work for the employer / client and get paid ?
Appreciate your inputs in this area.

For me it took 1.5 months. I visited the consulate to check the status. Typically you can check the status of your passport renewal from CGI mail room. They can tell you whether your passport is processed, mailed etc.
Unfortunately CGI Houston has very poor customer service. They won't answer your calls or reply to your emails.

Hi all,
I filled I-485 in 2007. Now I am waiting on the status adjustment and I have a quick question about job changes.
A starting-up company with only 2 employees has got a contract outside U.S.. They need to hire somebody to work for them outside U.S. for 1 year maybe longer. I happen to be their best candidate. My question is whether a small company like this one is able to sponsor me to get my GC. Does USCIS have minimum requirements for a company which can sponsor employees' GC application? For instance, a company must have at least 30 employees or over $3 million revenue. I really want this opportunity. But I don't want to ruin my GC application.
I greatly appreciate your time and your answers.

Some of my friends who are in their final year of a residency program on a H1b (non profit) have got job offers from profit organizations and their H1b transfer is subject to cap. Their transfer will be done only in May/June 2007 and now they are stuck because of the cap limit.
A lot of people in same situation are IV members. SOme organized effort is required to this cause.
These maybe people who could not file for their "real" jobs when cap was reached.
Must we not start an organized effort and let our law makers know about this situation.

I have question , How long it will take after submitting the evidence . I have received RFE on Jan 15 and submitted 03/25/2008 and I have seen LUD 03/27/2008 .
How long they will take time to decide the case?

in order to get the animation to 'stick' you have to toggle that button that says "animate" on the top of the screen. The reason they do it that way is this. If you've already set up an animation, but then find that you need to change something in the basic structure of the item, you can turn off that toggle, edit the item and have it not effect the animation that you set up.

Our I-485 applications were received by Texas Lock box on September 24th. I have not received the receipt number yet. We are leaving to India on Nov 20th for vacation, its quite stressful because we need that receipt before we travel.

GC/485 is for a future job.So if your former employer is willing to not revoke your 140 and answer ability to pay issues if required,then i guess you can file 485 with your old employer.

I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:
Have H1B active with current employer till Feb 2009
Just got my priority date current - EB2 July 2004 for India
I-140 approved, I-485 and I-140 filed last year receipt date Sept 2007
Questions:
How can I get new EAd now?
I can continune working on H1B correct?
Any impact on my 485 application that now will process due to PD being current?
PLEASE HELP. I am confused and worried a bit.

I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(

Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. My friends h1b got rejected 2years back , he once again applied for new one in this fin year from diffrent company , does old petion will effect the new one, as he not shown th eold one while filing the new one
