Please let me know how do I convert TR labor pending in BEC to RIR.
Accoding to recent law, I know that we can do it
My original application was filed under RIR and my RIR has been rejected and my LC went back to TR queue. I also know that you can again convert back to RIR from TR even if original RIR is rejected.Blood $uckers took 4 years to tell this.

Hi,
My fiance has filed for h1 extension. we will be travelling to india for marriage by dec. since petition papers are not expected to come by December, i was thinking if the following can be done
1. she comes along with me under h4 visa.
2. once petion paper comes, her visa status changes from h4 to h1 and then she can continue her job.
is this possible?
will h1 visa processing continue to happen when one comes to US under H4 visa.
kindly suggest.

When you have no GC and are on h1 legally...can you go on a cruise..I do not have stamping on the PP ..the cruise goes to some places in the caribean??..is there a immigration check while comming back??..how does this stuff work...OR is it no GC no Cruise??..

I got laid-off in Jan'09 and was not able to get a job. I returned back to India on 01-May-2009. I would like to come back to US since the economy is coming-up. Below is my situation:
Filed I-485 and it is in Pending status (Priority Date is May-2007). I-140 approved in Jan 2008.
Renewed EAD which is valid till July 2010. But AP got expired by 15-July-2009.
6 years of H1B expired by 31-May-2009.
1. What are my options now to come back to US?
2. When can I file for my new H1B? I heard there should be 1 year gap between H1B.
3. Will I be considered in regular quota OR I will get H1B on previously held quota?
Your suggestion will greatly help. Appreciate it.

Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

Hello all
My wife dint work for a while on H1 status,but changed back to H4 after working for 6 months with change of status from H1 to H4 at INS..so currently she is on h4..
Will there be an issues during adjustment of status thru at 485 stage..will her details be checked in..?
