max, the problem is there is no clear cut definition of how an IO is supposed to respond to the scenarios you mentioned.
but i suggest that you search IV archives as this subject has been discussed in-depth before. i remember 1 or 2 ppl posting their AC21 and subsequent GC approval experience via self-employment/ LLC registration.

A Masters degree or Bachelors + 5 years of progressive experience is the minimum requirement for EB2. In addition, your employer must justify in the future job description, that they require to hire a qualified person like you. Yes, it is the lawyer who decides on the employment category.

Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .
Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status

Hi,
I recently got a 3yr extension from my Company(6 yrs completed) since my Labor and I-140 is cleared, My question is can I transfer my H1 to another company, if yes how many yrs of extension I will get and what will be my GC status, can I transfer the priority date to the new company.

My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.
2. Will the h1b application get rejected or queried.

Hi All
Can anyone please tell me,
when i had downloaded the "May-Preview" and "August-Preview" of expression Blend, it has 3 options for "New Project Type" :
1. Standard EXE
2. Control Library and
3. Silverlight Application (Java Script)
But when i downloaded and upgraded with the latest version, the last option (SilverLight Application) is not there.
Can anyone please tell me,

My wife is on her first year of OPT, she is masters in STEM so she is eligible for 17 month extension.
In-order to re-new her OPT she needs get herself e-verified. However, her employer said thay they are not registered for e-verify system.
My question is �
- Is it possible to renew OPT without e-verification, if yes how?
- What are options in that case if her employer does not e-verify?

Hi,
When I entered USA on L2 dependent spouse visa,my passport was expiring on 15 Sept 2008 and hence my I-94 got departure date as 15 sept 2008. After that i applied for an L2-EAD with the old passport and I-94 (both having expiry date as 15-sept-08)and hence i got the L2-EAD which also expires on 14-sept 2008.
Now I have renwed my passport which is valid upto 2018 and want my EAD to be renewed.
Can someone tell me L2 EAD expiry date depends on I-94 records or does it depend on my spouses L1 or on my new passport expiry date...or may be out of all these which ever expires first....??

Hi all,
I filled I-485 in 2007. Now I am waiting on the status adjustment and I have a quick question about job changes.
A starting-up company with only 2 employees has got a contract outside U.S.. They need to hire somebody to work for them outside U.S. for 1 year maybe longer. I happen to be their best candidate. My question is whether a small company like this one is able to sponsor me to get my GC. Does USCIS have minimum requirements for a company which can sponsor employees' GC application? For instance, a company must have at least 30 employees or over $3 million revenue. I really want this opportunity. But I don't want to ruin my GC application.
I greatly appreciate your time and your answers.

Hello friends
I am thinking of taking these semester off because of my health issue
I had decided to attend classes and booked my ticket in April to my country. I am an international student
So I was thinking how many months I can stay in USA after I take a semester break
Also if I take these spring break off and than the summer break is off by default so will it be a problem if I am not in status for 7 months?

its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....
