Guys, applied recently for EAD and its pending and 180 days has not passed. I am planning to open a part time business. Does anyone know if its ok to start a part time business before the EAD gets approved ? Any insights will be appreciated.

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. [B]I came to US on March 28th 2008 on H4 Visa and applied on March 29th for new H1B with COS for Oct 2008 quota. I see the h1b approval of I129 petition on Jun 2, 2008 WITH attached I-94 WITH IT. Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

My 485 is pending and and I am still working on h1. I have EAD and advance parole, but do not want to use parole to go to canada (Wanted to save it for India trip). Do I have to take canadian visa to travel to canada for 3 days based on my currnet status. what is the process to take the visa?

Parents frequently come to the US but I may need to travel to Pakistan for emergencies or perhaps to get married. Should I go to Pakistan or Canada for H-1b stamping or is too risky with the lengthy administrative processing (221-g)?

Hi everyone,
Here is my situation and I need URGENT help.
I am currently on L1-A for past 7 years (Visa expires Nov 07). During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.
I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?
Please reply urgently if anyone has the answer to my question as I am running out of time.

I am a July filer who has been working with his company for 5 years on H1. I have an offer to switch jobs and I am contemplating using EAD (I renewed it in 08,just never used it).
The new employer has verified my status using e-Verify. What surprised me is that , as soon as the verification was done, my existing employer called me and started asking me if I was planning to use the EAD and if they can do anything to alleviate my concerns about my compensation etc.
There is not way my current employer would know about my intentions since I maintained the confidentiality.
Does anyone know if e-Verify informs the current employer somehow? Do they receive a call from USCIS for any verification? Could this be a matter of concern?.

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...
If you are sure that employer will be very cooperative, then you can easily shift now ...

My PERM was filed in Dec, 2006 and was denied on April, 2007. As per my employer's lawyer it was erroneously denied by DOL. The lawer has received the denial letter but no reason was stated. He was keep on follwing up with DOL but no answers. On Aug 2007, lawyer was followed up again directly with the DOL office in Atlanta , with the liaison at the American Immigration Lawyer's Association and also it was sent to the congressional office. Through Senetor we came to know that there was typo in the date field. The lawer is persuing to get the denal letter again with reason so that we can appeal. But we have 10% chance to get the another deial letter. Now lawer is asking for filling a new PERM. In between I lost 8 months and now I'm running out time. My 6th year is expiring on Sept08. Just incase if we din't get denial letter and file the new PERM on Mrach can we get the 7th year extension ? (We will show all the documents etc for previos denail case and there was no reason in denail letter. PLEASE HELP

I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?
